TERMS OF SERVICE

1.1 FOMODEX.com (or its subsidiary brands) accepts the placement of Advertisement or Advertisements (as defined below) by an individual or business (the “Buyer”) on the FOMODEX.com website (“Website”) to be viewed by members of the public (the “User” or “Users”) subject to the terms of service set out herein (“Terms”.)

2.1 By accessing the website at https://fomodex.com/ you are agreeing to bebound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2.2 FOMODEX accepts the placement of Advertisement or Advertisements (as defined below) by an individual or business (the “User”) on the FOMODEX website https://fomodex.com/ (“Website”) subject to the terms of service set out herein (“Terms”.)

2.3 These Terms of Service apply to:
The placing of advertisements in the form of Post Ads, Global Ads or Website Banner Ads on the fomodex website or its subsidiary brands on Telegram, together “Advertisements”. By placing an order, the “Buyer” accepts and agrees to be bound by these terms in full.

3.1 FOMODEX or its subsidiary brands offers different types of advertisement that may be placed on the Website. These are Post Ads, which will be placed at the foot of each Telegram trade post, Global Ads, which are best used for placement on different channels within a limited time period, and Website Banner Ads, which are placed on website headers.

3.2 The Buyer guarantees to FOMODEX that any information supplied in connection with the Advertisement is accurate, complete, true and not misleading; the Advertisement or the Advertisements are legal, decent, honest and truthful, are not contrary to the provisions of any applicable law, regulation or code of practice, including the Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 (as amended), as reflected in the rules and guidance issued and enforced by the Financial Conduct Authority (FCA) as well as all advertising codes under general supervision of the Advertising Standards Authority.

3.3 All Advertisements and any image uploads of logos must not contain anything which may be considered offensive or otherwise inappropriate.

3.4 FOMODEX reserves the right to reject a request for placement of an Advertisement or to remove an Advertisement or Telegram posts where deemed necessary, at its sole discretion. Reasons for rejection include, but are not limited to, knowledge of fraudulent activity, a lack of data on the submitted form, low trade value or a conflict of interest. If FOMODEX rejects and cancels an Advertisement before it has been placed live on the Website, the Buyer will be notified.

3.5 FOMODEX shall not be liable for any error, misprint, inaccuracy, omission or breach.

3.6 The Buyer agrees to complete the form for placement of the Advertisement or Advertisement and submit payment through means of only two established forms of cryptocurrency, these being ETH or USDT.

3.7 FOMODEX maintains complete independence and is free of influence from any party whatsoever. No payment shall ever be taken in the form of presale tokens, presale tokens for new projects (ICOs), airdrops, or any such similar forms of currency. The only form of payment accepted is BTC, ETH and USDT.

3.8 As a fully independent entity, FOMODEX provides advertising services to the Buyer in exchange for payment. FOMODEX does not provide any advice whatsoever and remains completely unbiased. FOMODEX does not provide any advice, makes no claims who regard to the promotion of any business or currency and is not influenced by any party whatsoever.

3.9 FOMODEX will endeavour to ensure that the advertisements where the Buyer has made payment in full will be placed live on the Website and or Telegram posts within the agreed time period. The Buyer will be notified that the advert is live by means of either E-mail,Telegram or Twitter. If in any instance payment has been made but the form has not been completed, or the form has been submitted but payment has not been made, the potential Buyer will be contacted by means of Telegram.

3.10 The Buyer warrants, represents and undertakes that any website landing page to which a User is directed by a domain name or hyperlink contained in an Advert contains a prominent link to the website’s privacy and cookie policies which shall comply with all relevant data protection laws including but not limited to, General Data Protection Regulation.

3.11 Any personal data collected pursuant to the Advert shall be collected lawfully and used only for lawful and permitted purposes; and the Buyer shall not post cookies or any other tracking technology in an Advert or in any other material submitted to us without the prior consent of FOMODEX.

4.1 When a Buyer places an Advertisement with FOMODEX, information will be received by FOMODEX, normally including contact details and anything personal or business related information which has been included in the Advertisement itself. FOMODEX will use such information as detailed in the Privacy Policy.

5.1 FOMODEX places the Advertisements on behalf of Buyers. Buyers are required to adhere to all legal and financial regulations; however, FOMODEX does not warrant that any of the Advertisements on its website are accurate, complete or current.

5.2 FOMODEX provides links to third party sites for your convenience. Such sites are not within the control of FOMODEX and may not follow the same standards of privacy, security or accessibility. Users should be aware that FOMODEX does not control links to external websites nor does it have any control over third party websites and therefore cannot be held liable for the content of such websites.

6.1 Users are warned that trading in cryptocurrency carries a high level of risk and may not be suitable for all Users. The possibility exists that a loss could be made. Users are advised to complete their own due diligence and consult their financial advisor prior to making any investment. Under no circumstances shall FOMODEX be liable for any loss or damage incurred through information or Advertisements placed on the FOMODEX website, through fomodex.com or any Telegram channel managed by FOMODEX

7.1 FOMODEX is unable to make guarantees as to the functioning of third party websites and the complete absence of a data feed stop, outage or SIM card deletion at any time. In no event shall FOMODEX be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the FOMODEX Website, or due to the failure of Uniswap or other platforms, Telegram, an API or any other third party, for any reason whatsoever.

8.1 The Buyer hereby indemnifies FOMODEX and shall keep FOMODEX indemnified on demand and hold harmless from and against all losses, damages, fines, demands, claims, proceedings, awards, costs and/or expenses whatsoever (including consequential loss and loss of profits, legal and judicial expenses) suffered or incurred, directly or indirectly, pursuant to a failure to comply with these Terms of Service by the Buyer or otherwise in connection with the placement of an Advertisement placed by at the request of the Buyer

9.1 FOMODEX reserves the right from time to time to alter these Terms of Service without notice. FOMODEX shall endeavour to provide notice to those likely to be affected by such changes, by such means as telegram or Twitter, but this will not always be possible.

9.2 FOMODEX may make changes to the materials contained on its website at any time without notice. However, FOMODEX does not make any commitment to update the materials.

9.3 FOMODEX may transfer this agreement to another party. By accessing the FOMODEX Website, a Buyer or User expressly agrees that FomDex may assign, novate or otherwise transfer these Terms of Service in whole or in part to any other party.

10.1 These Terms of Service are governed by and construed in accordance with the laws of the Netherlands and any Buyer, User or other party accessing the FOMODEX website and services irrevocably agree to submit to the jurisdiction of the courts of the Netherlands, without regard to conflict of laws and provisions.
